ANALYSIS OF THE LEGALITY OF FANTASY FOOTBALL
Section 3.4
Based on Article 303(3) of Indonesian Criminal Code ("ICC"), gambling is defined as :
-
a. a game that is generally won by relying on luck alone, even if such luck can be increased by a player's skill and familiarity with the game/by regular practice; and/or
-
b. betting on the outcome of competitions or games, which are not held by those who participate in that competition or game, as well as other kinds of wagering.
(hereinafter, collectively referred to as "Gambling Elements").
We appreciate that the drafting of the above provisions is not clearest. But in practice, the interpretation is that if a game is not entirely or mostly based on luck, it should not be perceived as gambling.
Section 3.6
Fantasy Football in essence is a simulation of managing a football team. For a Player to be successful in managing his/her football team, the Player has to analyse and learn about, among others, the performance statistics of the real-life football players and purchase the football players that they consider to be the most skilful or the best performers in their respective positions. This should support the proposition that Fantasy Football is a skill-driven game.
Section 3.7
As in a real-life football game, however, there are other factors that cannot be controlled by the skill of the Player, e.g. the health of the real-life football player and
the football market trends that may determine the performance of such football player in the relevant period in which the Player plays Fantasy Football. As such, we cannot dismiss the fact that the element of "luck" also plays a role in Fantasy Football.
Section 3.8
Notwithstanding the above, and given the similarities of Fantasy Football and actually managing a football team, one might take the view that Fantasy Football is mostly skill-based, and therefore should not be deemed to be gambling.
